The EU-US Safe Harbor Does Not Protect US Companies with Unsafe Privacy Practices - 0 views

    "Recently, the Federal Trade Commission (FTC) has gotten tough with US companies that have not lived up to their own privacy promises to European consumers. In particular, it has filed complaints against seven US companies that claimed that they were adhering to the European Union's Safe Harbor Program, but allegedly were not. (The FTC issues or files a complaint when it has "reason to believe" that the law has been or is being violated, and it appears to the Commission that a proceeding is in the public interest. The complaints themselves are not a finding or ruling that the named parties have violated the law.) By taking action, the FTC has shown that the Safe Harbor program, as applied to US companies, is not a set of empty promises. Rather, the FTC is keeping watch over businesses and will sanction those that misrepresent their own policies. In this column, I will explain how the Safe Harbor program works, and also discuss the recent FTC enforcement actions."

What's more, in two cases, the recipients' efforts to restore patients' privacy were rebuffed, suggesting the federal Health Insurance Portability and Accountability Act (HIPAA) is falling far short of its promise to protect and enforce patient privacy.

Hathaway: White House Must Lead in Cybersecurity - 0 views

    Obama administration cybersecurity advisor Melissa Hathaway, in her much anticipated speech before the RSA Conference on Wednesday, suggested that the findings of a study she submitted Friday to President Obama calls for cybersecurity policy to be run from the White House. "The White House must lead the way forward with leadership that draws upon the strength, advice and ideas of the entire nation," said Hathaway, acting senior director for cyberspace for the National Security and Homeland Security Councils. Scant on details, Hathaway in her 2,400-word speech did not explain how federal cybersecurity should be governed, even if it's based in the White House. Two months ago, President Obama charged Hathaway to head up a team to review current cybersecurity policies and processes. "It can be said that the federal government is not organized appropriately to address this growing problem because responsibilities for cyberspace are distributed across a wide array of federal departments and agencies, many with overlapping authorities and none with sufficient decision authority to direct actions that can address the problem completely," Hathaway said. "We need an agreed way forward based on common understanding and acceptance of the problem." Hathaway said the team she assembled addressed all missions and activities associated with the information and communications infrastructure, including the missions of computer network defense, law enforcement investigations, military and intelligence activities and the intersection of information assurance, counter intelligence, counter terrorism, telecommunications policies and general critical infrastructure protection. Task force members held more than 40 meetings with different stakeholder groups during the 60 days and received and read more than 100 papers that provided specific recommendations and goals, she said.     The first sign that something was wrong seemed harmless: A new Dell credit card arrived in my mail one afternoon. More landed in the mailbox the next day. Macy's. Bloomingdale's. Crate and Barrel. Radio Shack. Then later: Visa Sony, Toys R Us and Lowe's cards turned up. I didn't request any of these cards. My first call to Dell revealed what I suspected. Someone had applied for a credit card using my name. I felt violated and vulnerable. Then, it hit me: I've become a statistic, a victim of identity theft. A thief had taken my name, my credit and my identity and managed to spend more than $8,000 (money that, I'm grateful, I didn't have to pay). I still don't know who the culprit was or how it happened. All I know is that if this happened to me - a Sun Sentinel consumer affairs and watchdog reporter - it can happen to anybody. Thieves move quickly Identity theft is the fastest growing crime in the United States, according to the Federal Trade Commission, which enforces identity theft laws. Experts estimate 10 million Americans become victims of identity fraud each year. Last year, businesses lost $56.6 billion to ID theft, the commission said. I've spent hours on the phone talking to fraud investigators, credit bureaus and bank staff as I've tried to sort out the mess that is now mine to clean up. I was exhausted every time a call ended. Individual investigations, conducted by fraud departments for each of the credit card companies that issued accounts in my name, took months to complete before concluding I was a victim of ID fraud. But there is a bright side to this story. I thought I knew how to protect myself. But what I've learned through this experience has taught me that you can never be too careful. I also learned some hard lessons along the way about how best to safeguard my personal information in the future - and respond, if my identity is targeted again.

Thousands of Floridians may have been affected by hotel data breach -- South Florida Su... - 0 views

    Up to 21,000 Floridians may have been affected by a data breach at Wyndham Hotels & Resorts last year, prompting Attorney General Bill McCollum to ask consumers to keep a close eye on their credit statements. According to a statement released today, Wyndham reported to the Attorney General's Office that it contacted affected consumers in December and notified them that unauthorized access to Wyndham systems had potentially compromised their personal data on their debit and credit cards. The data breach has since been disabled. McCollum encouraged consumers to report any suspicious activity on their accounts to law enforcement. Affected consumers are encouraged to take precautionary steps, including obtaining a free fraud alert from one of the credit reporting agencies. Anyone who believes they may be a victim of identity theft should also request that the national credit bureaus place a fraud alert on their credit reports. Consumers should notify banks and creditors involved of questionable charges or accounts, keep records of all telephone calls and follow up in writing with credit bureaus, banks and creditors.

Man accused of ID theft tried to surrender, turned away - 0 views

    For the second time in the same case, law enforcement in Denver turned away a key component in hundreds of instances of identity theft. The first time, it was a box full of stolen documents found in a storage unit, turned away by a Denver Police officer. This time, it was the main suspect, turned away by the Denver Sheriff's Department. The Denver Sheriff's Department admits the man believed to be at the center of an identity theft operation, 46-year-old Paul Simmons, tried to turn himself in at the Denver City Jail 16 hours before police arrested him. A warrant had been issued for his arrest and was entered into the system at 10:15 a.m, according to Sonny Jackson, Denver Police Spokesman. Sheriff's spokesperson Capt. Frank Gale told 9Wants to Know Tuesday that Simmons walked into the Denver City Jail around 8 p.m. Monday night. The Denver Sheriff's Department runs the city jail. It is not staffed by the Denver Police Department. Gale says Simmons told a sheriff's deputy he had received a call from an investigator with Denver Police saying he was wanted for questioning in connection with the identity theft case featured on 9NEWS. Gale says the sheriff's deputy then told Simmons there was not a record of him being wanted in the computer, but sent Simmons to check in with the Denver Police Department housed in a separate building across the courtyard at 1331 Cherokee St. Gale said the deputy did not know if Simmons ever made it to the Denver Police building. Denver Police spokesperson Sonny Jackson said Simmons never did. "We really wish he would have taken the 50 steps across the courtyard and talked to us, that would have saved us a lot of time today." Jackson said. "If he [Simmons] really wanted to turn himself in we would have been more than happy to take him into custody."

Heartland Payment Systems Discovers Data Breach - 0 views

    Heartland Payment Systems, the sixth-largest payments processor in the U.S., announced Monday that its processing systems were breached in 2008, exposing an undetermined number of consumers to potential fraud. Meanwhile, Forcht Bank, one of the 10 largest banks in Kentucky, told its customers it would begin reissuing 8,500 debit cards after being informed by its own card processor of a possible breach. In the case of Heartland, while the company continues to assess the damages inflicted by the attack, Robert Baldwin, the company's president and CFO, says law enforcement has already noted that the attack against his company is part of a wider cyber fraud operation. "The indication that it is tied to wider cyber fraud operation comes directly from conversations with the Department of Justice and the U.S. Secret Service," Baldwin says. The company says it believes the breach has been contained. Heartland, headquartered in Princeton, NJ, handles approximately 100 million transactions per month, although the number of unique cardholders is much lower. "It is still a question as to the percentage of the data flow they were able to get," Baldwin says, adding he would not speculate on the number of cards potentially exposed. Specifics surrounding when the breach occurred are still being analyzed. But Baldwin says two forensic auditing teams have been working on the breach analysis and investigation since late 2008, after Heartland received the notification from Visa and MasterCard. The investigation began immediately after the credit card companies told Heartland they saw suspicious activity surrounding processed card transactions. Described by Baldwin as "quite a sophisticated attack," he says it has been challenging to discover exactly how it happened.

    Identity thieves are getting more clever and are increasingly using stolen information to get driver's licenses, employment and government assistance, according to a new report. The survey by the Identity Theft Resource Center also found that the greater awareness of this problem by the public has led to more people discovering they are victims themselves, through monitoring of their bank accounts and credit card statements. Typically, victims learned of their identity theft when they were denied a job or credit or were informed by law enforcement. "Most of our information is beyond our control," said Linda Foley, co-founder of the Identity Theft Resource Center, which surveys victims each year to see how identity theft is changing. "If a thief wants to get it, he will find a way to get it." The report covers the experiences of around 100 of the 1,500 people who were victimized in 2008 and contacted the center, a nonprofit that helps people recover from identity theft. Stolen personal information is now cheap - identities may sell on the black market for as little as 60 cents each - and thieves churn through them quickly to lower their chances of getting caught, Foley said. Rather than opening 10 or 20 credit card accounts in a victim's name, they now open two or three, charge as much as they can and move on to the next person. This raises the cost of identity theft to businesses, whose average loss to fraud nearly doubled last year to $90,107, up from $48,941 the year before.

The Associated Press: Amex cardholders' data stolen by employee - 0 views

    Some American Express card members' accounts may have been compromised by an employee's recent theft of data, the company said Thursday. American Express Co. spokeswoman Susan Korchak said a "relatively small portion" of card members was involved, but declined to be more specific. The former employee has been arrested and the company is investigating how the data was obtained, she said. The company is in the process of notifying affected card members by letter. In one such letter sent last week, American Express Privacy Officer Alfred Silipigni said he was informing the member of "an unfortunate issue" concerning his card. "We recently learned that certain account data was acquired without authorization by an employee who is no longer with the company," he wrote. "The former employee has been arrested, and we are cooperating with law enforcement authorities with their ongoing investigation." American Express declined to disclose any more details about the incident beyond what was in the letter. The company has put additional fraud monitoring and protection controls on the accounts at issue, Korchak said. American Express has about 39 million corporate, small business and consumer cards in force in the United States.

No Easy Answer for Protecting Kids Online - WSJ.com - 0 views

    There is no simple technology solution to protect children from bullying, pornography, sexual predation and other online threats, a new study says. The highly anticipated report -- results of a year-long study ordered by 49 state attorneys general -- found that "a combination of technologies, in concert with parental oversight, education, social services, law enforcement, and sound policies by social-network sites and service providers, may assist in addressing specific problems that minors face online," according to a draft of the report reviewed by The Wall Street Journal. The report also found that the risks that minors face on the Web -- notably bullying and harassment by peers -- aren't very different from those they face in the real world. The report is scheduled to be issued Wednesday by the Internet Safety Technical Task Force, led by Harvard University's Berkman Center for Internet and Society. Task-force members included representatives of several top Internet and security companies, including News Corp.'s MySpace, Google Inc., Time Warner Inc.'s AOL and Facebook Inc. (News Corp. also publishes the Journal.) The 278-page report is a boon for the Web companies, which have long argued that technology isn't the sole solution to the dangers kids face online. It is a disappointment for those in favor of stricter technological controls, such as age-verification and filtering tools.

FDIC Warns of Online Fraud Against Banks, Small Businesses - 0 views

    Online crime is increasingly hitting small and mid-size companies in the U.S., draining those entities' bank accounts through fraudulent transfers. The problem has gotten so bad that a financial services group recently sent out a warning about the trend, and the Federal Deposit Insurance Corporation (FDIC) issued an alert today. "In the past six months, financial institutions, security companies, the media and law enforcement agencies are all reporting a significant increase in funds transfer fraud involving the exploitation of valid banking credentials belonging to small and medium sized businesses," says a bulletin sent on Aug. 21 to member financial institutions by the Financial Services Information Sharing and Analysis Center, (FS-ISAC). The FS-ISAC is part of the government-private industry umbrella working with the Department of Homeland Security and Treasury Department to share information about critical threats to the country's infrastructure. The member-only alert described the problem and told its members to implement many of the precautions and monitoring currently used to detect consumer bank and credit card fraud.

    Sears today agreed to settle Federal Trade Commission charges that it failed to disclose the depth of consumers' personal information it collected via a downloadable software application. The settlement calls for Sears to stop collecting data from the consumers who downloaded the software and to destroy all data it had previously collected. If Sears advertises or disseminates any tracking software in the future, it must clearly and prominently disclose the types of data the software will monitor, record, or transmit, the FTC stated. Sears must also disclose whether any of the data will be used by a third party, the FTC said.

    Those who are superstitious may believe that bad things happen on Friday the 13th, but we will leave it to each individual and entity to formulate conclusions regarding the Health Information Technology for Economic and Clinical Health Act (the HITECH Act), which Congress passed late on Friday, February 13, 2009, and President Obama officially signed into effect on February 17, 2009. The HITECH Act addresses various aspects relating to the use of health information technology (H.I.T.), including providing for federal funding by way of grants and incentive payments in order to promote H.I.T. implementation. This Alert focuses, however, on Subtitle D of the HITECH Act, which includes important, new and far-reaching provisions concerning the privacy and security of health information that will materially and directly affect more entities, businesses and individuals in more diverse ways than ever before. These changes are further elaborated upon below, but this Alert can only highlight certain prominent issues under the HITECH Act and is by no means a comprehensive review of this lengthy and complex Act.
